I don't think that's going to help anyone now. If it was plainly obvious weeks ago a cryptic message on here for people to PM you if they're dealing with SK Performance might have saved a few people some stress. Maybe something to think of in the future.

If they've sold your car to a genuine buyer and then not given you the money, that is a worrying situation. I never considered the place was crooked before.

If they have not sold your car, then I would expect to get it back.

Fingers crossed for you guys. People like this are terrible.

You might have an assumption, but until it happens, it is just an assumption. I bet 50% of such specialist car dealers are on the edge from week to week. A sure thing to put a dealership under would be an assumption made public by another dealer. It's not going to happen.
Selling a car on a commission basis is a risky business. It has to be part exchange or private personally. I don't think you make more money selling on commission compared to part ex anyway. You have to all pay for the dealers sales margin and warranty cost. The only reason I guess it would be worth the risk is when you are selling for the cash and not buying another car, and it's a type of car difficult to sell privately.

You expect Dicky to put details of a "suspect" dealer on a public forum to warn everyone away from them even in "cryptic message" form? Can you imagine what would happen if all dealers did this on a feeling or hunch they got from a visit?

As Mike says "A sure thing to put a dealership under would be an assumption made public by another dealer" and would also be Libel if found to be an untrue statement.

In your words "Maybe something to think of in future"?

I just hope that you can with the help of the DVLA and Police request and determine the name and address of the person who has tried to register the vehicle in their name (if it is the SCAMMER who has applied for the V5C) and locate the exact location of your car. I really hope you get a happy outcome from this mate!

Is this where "ownership is nine tenths of the law" comes into play?

It's a dreadful state of affairs and perhaps a need to sign a contract saying the car cannot be sold without the current owners signature on the log book.

I know it's all well and good trying to shut the gate once the horse has bolted but this should be a warning to us all, this is the second time I have heard this happening.

If they sold it before they went under, it should be documented in their accounts with money received from the purchaser. If they sold it and the money is not received in their company accounts, it's surely theft? The liquidators should know one way or another?

Solid advise there.
They are obviously confident that they are 'top of the tree' within the trade and can point out the shadier car dealer practices.

What can go wrong with commission / sale or return deals?
If once your car sells the dealer shuts up shop before you get paid then you have lost all your money. You can't go to the new owner and ask for the car back because you gave the dealer permission to sell it. Neither can you claim on your insurance for the same reason. Handing over a car to sell is like giving the dealer cash to the value of the vehicle.

Friend got caught the same way. SOR - his car was sold, V5 was changed, buyer was invoiced for the car and the buyer paid.

The dealer was acting as my friend's agent, received payment for the SOR car and then went bust. My friend lost his money as he was deemed to be a creditor.

The law is pretty brutal if you are the party who has the dealer acting as your agent.

Worrying really. I personally wouldn't trust any dealer apart from the ones I know and have dealt with in the past.
