Sale or Return cars will be returned to owners, no question. They are specifically not the assets of the business and ownership is always retained by the individual owner. The administrator/liquidator would have saved money looking through the paperwork first before spending money transporting and storing cars the business do not own.

Am very lucky, it's amazing how quickly this happened all seemed well only a few days ago.

Yes, it does tend to happen without warning like this. Which is why it would be interesting if Dicky followed up on his comment that he is not surprised this has happened based what he saw weeks ago.

In the end, there were many people who where caught mid-deal and lost deposits etc. The owner has been on the run ever since. They were well known for supplying to the councils and for taking cash for cars from those who found themselves with undeclared money, if you know what i mean!

One of my colleagues has to fight with Barclays as he had traded in a Seat Leon FR for a new one and they had not settled the outstanding finance on the traded in car. It was fine in the end but he had a few crazy days while he sorted it out.

that's why the money laundering laws were introduced, 30 years ago I had a mate the worked at a ford dealership, they had a granada estate in the window, a member of the travelling community asked how long it would take to put it on the road, I think it was 3-4 days until he produced the full retail price in cash and plonked it on the desk then it became that afternoon

hi Rossyl - how do you know this? do you have contact with police etc? this bunch of clowns have had a car of mine but im yet to be told when It will be returned..

****. If they have sold it (letter from DVLA advising new keeper), received the money from the buyer (new keeper), but not paid you, you become a creditor I believe.
I hope I am wrong but I have a good friend that is in insolvency that I can check with.

Sounds like a deliberate scam to me. If they'd sold the car legally/properly they would have told the owner and filled in the V5 accordingly. The fact he's received notification from the DVLA suggests somebody has made an application for the V5 in a new keeper's name without his knowledge or consent. I am no expert on the law, but if the owner of the car has not made a sale agreement and the garage do not own the car he should have it returned. It's his property, not an asset of the garage. If they had a hire car on the premises this wouldn't be seized as an asset of the business and sold to pay creditors.

Hope you are right, you don't receive notification from the DVLA I recall normally?, but its been a while since I sold a car normally. My Elise was sold to a chap in France and in that case I did get notification from the DVLA it had been exported.

All you get these days from DVLA is confirmation you're no longer the registered keeper as of a given date. That then excuses you from any liabilities relating to the car - parking/traffic offences, road tax etc. In this case somebody has tried to get the V5 changed behind the owner's back to a different keeper. It stinks of illegality, especially given the firm has gone bust. Many an honest person is turned by impending financial peril. Thank goodness the car has been transported to somewhere safe. It could have easily disappeared otherwise. My thoughts go out to the owner and likely the other owners caught up in this mess.

You need to speak to the administrators!
Did you have a contract signed before it went for commission sale? something with wording like 'title of car passes onto new owner on receipt of payment'? That way, if they did sell it, and you have not received the money, the title is still yours?

If they've sold it, they've stolen it. The buyer will be the one who unfortunately loses their cash AFAIK. You/the Police should be able to get the details of the 'new keeper' from the DVLA application.

Not if they sold it before they went bust, they are acting on behalf of the car's owner.
Its the window between the car being sold and they receiving the money, and the money being passed onto the now previous owner.
The butt clenching time, you don't own the car anymore, and the dealer has your money.
