Not if they sold it before they went bust, they are acting on behalf of the car's owner.
Its the window between the car being sold and they receiving the money, and the money being passed onto the now previous owner.
The butt clenching time, you don't own the car anymore, and the dealer has your money.

If its sold on commission, and the dealer has received the money for the car, you don't own the car anymore....however.....as I stated earlier, it also depends on the contract agreed for the commission sale. 'Title remains with seller until payment received in full', or something similar.
Sometimes its just a handshake however, with no contract, which is worth nothing.
It's a mess, that is all we know.

I'm not disagreeing, Mike. Just making the point that your comment came across as fact rather than conjecture. Unless I've missed something, the owner hasn't confirmed the car has been sold, or indeed knows the current location of the car.

You would think the first thing any decent company would do is call their customers... Not take up to 10 days to call them...I would pull the car back at the first opportunity.

It will be the IPs who call the customers when they have ascertained the current true position - they will be calling the shots now.

I have just spoken to the liquidisers who attended and yes the newspapers are correct. The Facebook message is a load of ****.
I've also spoken to the DVLA who advise MY name isn't on the V5 anymore... so legal advice is the way forward for me, as I currently stand I'm 52k out of pocket!

But V5 is nothing, it does NOT provide proof of ownership. V5 is details of registered keeper and basically a liability document for speeding offences etc....

I guess all you need is a purchase invoice detailing when you bought the car etc and in the eyes of the law you are the owner. I am willing to bet that the new owner (whoever is trying to register for a V5C) doesn't have a receipt and as Mark says is trying to SCAM and recover some money back.

i really hope Mark sorts this. Didn't you recently buy a Maser?

The owner of SK Performance has been selling the cars but keeping so of the money himself.. this is why the cars have been seized and the police were involved.

gets his just desserts. A cautionary tale for anyone considering SoR or commission sale of their car - keep all documentation, spare keys etc and don't hand them over to the dealer. Should make it more difficult to sell a car without your knowledge or consent.
