CEL MoT Failure after April?

Just had my 3200 Mot'd - it sailed through with only a minor blow on the exhaust to worry about. My CEL light has a mind of its own, sometimes its on, then it just goes off, no loss of performance so I dont really worry, however I am now led to believe that from April this year a CEL is an MoT failure - can anyone confirm this.
I know them very well although its a Kwik-Fit, the Manager is an old neighbour of mine and they have MoT'd, fitted tyres, even serviced (not the Mas!), all my cars for a number of years so I have no reason to doubt him.

It certainly is true...

On 1 January 2012, new rules were added to the current MOT by the Department for Transport (DfT) to comply with European testing procedures.
It's a pretty substantial list, but there's one which could mean big bills for thousands of drivers.
If your car has any illuminated warning lamps, whether it is the airbag, seatbelt, ESP, SRS, ABS or others, it will soon fail the MOT.
It's not all bad news. If your car's MOT runs out before the 31 March 2012 and you have a warning light that needs addressing, the testers will treat it as an 'advisory', i.e. advice on what needs to be done for the next MOT.
However, if your MOT is due after 1 April 2012, you better get your skates on and get the warning light (or other faults in the list below) fixed, otherwise you'll receive the dreaded fail sheet.

The AA has kindly published a summary of the new rules...

so how do they check the operation of said cel say on a 3200 , i would be well pisssed if i took my 3200 in without a cel light on , they play about with it trying to get said cel light on and the **** thing dont go out eeeeeekkk , can of worms i reckon

they would have to start pulling off plug sensors / breaking wateright seals etc not good practice , maybe Phil696 can enlighten us

Seats

It must be possible to secure the driver's seat fore and aft adjustment mechanism in two or three different positions. On electric seats the motors must move the seat fore and aft.

For anyone with flaky Maserati seats, it's time to memorise the seat reset procedure!

If I'm not mistaken Loz, the lights all come on during the startup procedure while the car does it's checks, then they all go off (well hopefully)...
pretty sure both mine do that, not sure if it is the same on a 3200, but would think so.
