I completely get that this seems utterly unfair and unjust.

However, life is never fair, and all of us are no longer children in a playground. Therefore, the question for Mark is how to try and turn a “poo panini” into a palatable meal, and what is in the best interest of his business...

If it was me I would be furious right now but just hide away biting my tongue until I calmed down a bit. Sit back for a few days, gather evidence from anything they post, claim etc then look at it with a clear head so you can have a calculated plan of action.
Speak to a lawyer but keep it to yourself, don't show your hand.
I very recently had an issue with someone taking items out of something that I purchased before it was delivered to me, no names mentioned but I love it and it makes a glorious sound:p.
I really wanted to go on a rant on the forum but instead went into it very calculated. End result I've had a refund of what I saw it was worth and everyone kept there fingers and toes :D

Seriously, talking onthis open forum is probably fine as we're by and large a little known community but Fbook, twotter and utube are different matters. Blabbing on about them stealing you glory basically showing them your hand and they can now change theirs...or get very very expensive lawyers in that you're not going to win...

As an update they have come back to me insinuating that I am lying and the savings they have made were after we had installed our kit. We installed in 2013. They started work in 2016.

Which quite frankly is absolute rubbish. As they would have reduced the gas consumption at a large hotel (which I know very well) by over 50% Which is simply not possible with impacting guest comfort (7 years experience tells me that).

I did point out that we went to the hotel on their request and did a download of what our kit was saving (in February 2016), and advised them it was in the presence of their employees and have the reports dated, and the names of who was there. Even the BMS engineer!

It would appear that they have effectively baselined the property with our kit switched off. And added our savings to their figures.

The silence from them is deafening! I can't see how they can change their hand. I have all the email correspondence and reports.

I'd still tone it down, though, and delete any and all comments which are a bit shrill. As my bike instructor taught me, it's all very well being in the right, but sod all use if you're lying in the road with a broken leg. Just be careful.

I would simply stick to the facts with any comments and you can't go wrong, lawyers cant do fook all if it's clearly factual and it can be proven and eventually they could be digging themselves a bigger hole anyway, like the old saying "if you live like a sheep then prepare to get fleeced" I never wanna be a sheep, especially in Wales;)

How annoying! This **** goes on in business all the time. I have always found that, first, take a deep breath and don't react too quickly, and second, go straight to the top and don't talk to middle management.

Politely request a meeting with the CEO, or even a board member or better still the owner (for example, if it were a family business) and calmly, with lots of very clear evidence, state your case. I would advise not to take a solicitor on the first meeting, to try a friendly approach. Tip: assume everything you say is being recorded, so, speak wisely!

Often, the owners/ CEO really won't know the facts, and you may find sympathy with them.

Point taken, but surely defending the work you have done is just as important?
If for example you had done some work and then someone else claimed it for themselves and got a huge order from another potential client you were to work with, you would feel somewhat agreived?

Your level of 'somewhat aggrieved' is totally understandable, and I would want to kick their asses / donkeys. If you can successfully punish them for what they have done, you may well feel better. But if you try to punish them and it does not work, or it harms you instead, you will feel worse. As MrsMarkMas says to me about once a day. "You can act how you want, or you can get what you want, but you can rarely do both."

(edit) Oh, and that means figuring out what it is that you want: apology, retraction, glory, cash, retribution, vindication, publicity - you should figure that out, first.

This must be very frustrating for you but as some of the other comments infer, remain professional so as not to risk impacting on your own reputation.

I concur with the advice around your legal position and if you have one - take action.

I also like the idea of contacting the CEO of the hotel chain as they will have a vested interest in the accuracy of the claims as they are likely to award more work on the back of it.

But get advice on your position as a large company with deeper pockets can easily outrun you in Court.

Move on Mark its not worth the hassle or the bile inside. Use the experience to your advantage in future job's.

I work in a place where far too many stand their ground and it never ends well... sometime it is best to walk away and live to fight another day.

Mark, I totally understand your anger. However, I agree with the majority on here.

You can't let emotion play a part in running your business. If you continue to pursue this I fear you will do your business more harm than good. Being seen to air your grievances like this could actually put off future clients doing business with you. Bad things happen in business and you sometimes you have to take it on the nose, learn from it and move on.

Better to let future clients know by word of mouth and continue to build your business based on your expertise and reputation. From what I understand Quim will struggle to fulfill future contracts without you as they don't have the expertise.
