First and foremost Thankyou Adam for doing the gentlemanly thing and offering an apology , things have got a little out of hand and hopefully this can be the end of it , after all at times we may all be in need of the services of people like Duncan at some stage and the last thing we would want is for people like him to stop advertising their services wherever they choose to do so , a genuine one can be a godsend at times , we only need to ask SimonM his bacon recently saved by a similar transaction , we just have to do our homework before we buy as best we can , and to be honest referral is by far the best way rather than dealing with someone blind

Now on to your questions.

The warranty is a return-to-base warranty, which means that the engine would need to be returned to me for repair, or replacement if it failed within the warranty period.

I would ask to be given the opportunity to inspect the engine, to establish the reason for failure, because, as I wrote before, may engines fail in service due to poor fitting or lack of maintenance.

If the cause was due to an internal fault, then I would either repair it at my expense or supply my customer with a replacement unit.

If the customer had also paid me to fit the engine, then I would fit it for them free of charge too.

Bear in mind that we are talking about an unlikely eventuality. Most engines have a serviceable life of well over 100000 miles, providing they are maintained properly. This particular engine has covered less than a quarter of that, so, all other things being equal, it is not likely to fail within 12 months or 12000 miles.

Sounds good to me Duncan been in the motor trade all my working life for over 30 years.
Just wish that other people operated the way you do would make my life a lot easier.

Adam, to be fair mate it doesn't appear you are giving credit to how warranties are exercised in practice. A potential financial loss on one engine is offset by the profit on the significant majority that don't require repair. And good warranty terms mean more people will buy. It's the same simple principle that makes insurance companies so profitable. If the seller only has one engine to sell, then your main concern is fair - in this case it is a "top rated" ebay seller with multiple listings clearly running a business selling multiple engines. Notwithstanding the obvious possibility of deception by ANY seller, about anything, common sense tells us which of the 2 types of seller this is... "vast loss" and "honourable" really don't have to come into it....."overall profitability" "sales volumes" and "business acumen" certainly do...

Plus in relation to your questions, the express warranty clearly states "repair or replacement" (not refund) and "return to base" (not that the car will be collected on a flatbed). Not sure how that can be misconstrued. In the absence of express terms, the implied warranty means that parts used to repair or replace would be equivalent to those supplied i.e. from an engine of similar age, condition or mileage. They don't have to be new as you didn't buy new. Intentionally fitting substandard parts in a replacement would then incur another failure, which would then need to be repaired under warranty again, which would cost the seller more! Plus the warranty offer states the seller will keep your old engine... plus the warranty offer states it's 1 year / 12K, not unlimited... all of these details make the offer of these type of warranty sustainable.

In fact, IMHO the only thing remarkable about this warranty is the 12 month term - it's generous compared to most - the actual terms of the warranty are all quite standard really as is the price (the only term I can see is wooly is the one stipulating the engine is "carefully run in"). Consider the alternative.... the offer to purchase a used Maserati engine, sold as seen with no express warranty terms. That's a lot less favourable, and a lot riskier, than buying one with a warranty with such as this, with such explicit terms for recourse! In fact, I wish I'd got this warranty on the engine I just bought! :ohh:

Ah i didnt realise it was an exchange service.
So if the engine failed then it would be removed and palated and sent back for assesment and repair.
Now i understand.

Duncan didn't advertise on here. The ebay ad was usefully highlighted by another member on here, but as usual they immediately raised some negativity and unfounded suspicions about the warranty offered. .

I did no such thing MAF.....merely asked opinions.....please don't twist my words.
