From what I've read the manufacturers will insist that the driver is in position to be in control if the need arises. So no sitting in the back seat having a few beers - the driver still needs to be available. Which makes the whole thing a bit pointless, really.

Well, embedded software in many *many* instances (medical devices, ECU's for in flight computers etc etc) certainly could cause loss of life. You'll still find the manufacturers aren't liable. Logic has little do do with law at this level, I'm afraid.

I'm pretty sure if the fault is found to be with the equipment that the manufacturer is indeed liable, it is just a case of proving it in those instances ;)

And yes, AdamN, the whole thing is a bit pointless, you might as well just catch the bus and actually have a few beers, albeit, concealed!
