I have a friend that got pulled over on his way back to the office just after he left a viewing, a police van with 4 coppers surround him and ask him to jump out the car, he did co operated and they asked him if he was on the phone and he said "i had the phone in my hand but was not using it"....

the thing is.....they have given him a producer and name is spelt right but they have his old address but the biggest thing he needs advice on is...............


the reg number they have put down is wrong!! im not talking 1 digit, im talking the whole plate!!

He drives a golf and he did put the car description right, black, golf etc...but the reg they put is a citroen!

what can he do??

Hes got 6 points that come off in may but with this 3 its close......

Producer doesnt mean points, does it?

How can they get the reg so wrong! If its as simple as a mistake on their part, take the docs and go to the station....it just sounds like they wanted to give you a slapped wrist for driving "while on the phone", whether you were or not.

Hes talked to a good friend and got good advice, also on mon hes seeing a solicitor so will let you know how it pans out....

He just has to say "not me guv, I wasn't driving that car at that time". The thing is, as far as the beaks are concerned, if they got the reg completely wrong, what else did they get completely wrong. Although it is a 3 pointer, he should be in the clear. IMO, any half decent solicitor can get him off. Tell him to pitch up without documents, as he doesn't have any for that car (Citroen) It is up to them to request the docs for a particular car (Golf). and if they haven't got his number they can't request the docs.

The Form HORT1 is to produce documents to confirm you have insurance, Licence and MOT. If he takes them down to the station they will be checked against the details on the HORT1, and a return sent to the Officer who requested them.

I would advice that he speaks to the Duty Sgt as the details will only be taken by a Civi member of staff who will be like a robot.

The Sgt should check the details of the Reg on the PNC and confirm its a different car and in my day write to the reporting officer telling him he's a clown. There will be an audit trail on the PNC to confirm that the road-side check was carried out on the right car without a cloned plate other-wise he pal should have been arrested.

This case would not stand up in court based on the facts presented.

DO NOT take in the documents for the car you were driving. You may find that the registration number in his pocket book might change, so, in effect you are incriminating yourself. Leave it the 7 days before producing, so memories will be getting hazier. Tell the desk officer you have not got the docs for the car and you don't know who owns the car and that you were not driving it at the time stated. This will be confirmed by the owner who, I assume, you have never met. Let them prove the case and do not volunteer any information.
