my local long established family owned garage do all my mot's on my motors and as I understand they do very well out of mot's, they have 3 qualified testers and do charge the full amount, mind you they do own their own freehold building, I personally don't trust garages that reduce the fee and can only assume they are hoping to fail cars that should pass or even make work up

Update: The MOT firm involved in my little issue have today replied that they would like to see the old differential so their engineers can assess. It's a step in the right direction from the outright NO they initially considered. Issue is that I don't actually have the original as it was returned as an 'exchange unit' - it's a bit like pushing a piece of wet rope up a hill. Its a fair request to be honest but all I can give them is a collection of photographs to ponder over. Lets see how this works out.

And the final chapter! After a lot of digging, a few mails back and forth with VOSA (surprisingly helpful people), some polite but 'robust' discussion with the garage chain involved - today agreed a 50% payment as 'goodwill' - which is a fair result.
Lessons learned:
Maserati and any other manufacturer do NOT make any recommendation concerning MOT - the international obligations get too tricky.
VOSA did until 2012 specifically exclude LSD from brake roller testing. Now they leave it up to the tester to determine if the vehicle is suitable for testing.
VOSA do have evidence of LSD damage likely caused by using brake rollers.
HR Owen seemed unaware of any potential issue.
So the onus is on us as owners to make testing stations aware!
Now I know!

There is no stipulation as to what a reasonable distance is, so this is open to some interpretation. And because there is no stiplulation it is diffult to see them prosecuting on that basis.
I let the mot run out on a defender once , I use a mechanic 30 miles away so rang vosa and asked if I could drive it that far to a pre booked mot , they said yes as long as it was directly there.

I didn't ask if directly was M6 -M65 or whether I needed to get a ruler out and go on every B road and farm track

On another forum a mot tester said he'd MOTd a traffic coppers own car, he'd been driving round since November with no MOT , I wonder if one of his mates ANPR'd him

Oddly the police do mention that they could if they so wished accept either 'the nearest' MOT station as being reasonable OR the nearest Special Vehicle MOT station for exotics to take into account potential repair - anything else they can prosecute. I have also used the 'booked MOT' to drive from Newcastle docks to Merseyside - eg ferry port to home with an expired MOT.
