Drunk driver (allegedly)

Driving round the M25 today I came across this “drunken” fool - this is just some of the footage I captured and in the end I dialled 999 and reported it to the police.

Blimey, that’s scary. He could’ve done huge damage a number of times in any number of lanes. I hope he was pulled over before something did happen.

Police have contacted me and confirmed they pulled him over and he was arrested.
They have taken statement over the phone and have asked for the dashcam footage which is being collected tomorrow.
They asked if I witness any actual collisions as the car had damage to the near side and front screen.

Well that’s good work then. Also shows the power of a dashcam, it’ll be pretty hard for him to deny anything given your footage shows the manner of his driving.

If the CPS might be prosecuting I would take down the video until he is sentenced or acquitted.
I thougt about that,but the police have said it makes no difference if I post on social media.

I suppose you might get sued for defamation if it turns out that the driver was having a stroke or a diabetic crisis or something..... You could just change the title to something less definite.

I wouldn't trust the Police on that. In client-solicitor terms, the Police are the client and the CPS are the solicitor.

And the collapse last year of all those sex assault/ rape cases due to failure to disclose evidence is because the Police often do not follow the basic rules of court procedure. Needless to say the CPS (as the prosecuting authority) got the blame but hardly their fault if their client does not know what to do (when they should really know better).

And @MarkMas is right that publication of a video with that title (even with the caveat of allegedly) could be considered defamatory if the driver was not under the influence.

Good points, I may well edit the title then.
In terms of evidence for the DD they won’t be using the dash cam footage and the cottage I am providing to the police is earlier (worse footage) anyway.

Unwritten rule in the Fire & Rescue Services, if it's a drunk driver and even if they can be released with ease, still dismantle the car!
No licence, no car and no insurance pay out.
